The Town Council of Albox illegally occupied the site of the Parque de la Avenida América
The Council never completed the appropriation which was determined by a ruling favourable to the owners that dates from 2014
A new legal challenge against the Town of Albox, this time on account of the vacant lot on Avenida América, owned by the Soto family. A land whose expropriation has never been carried out according to the procedures indicated by law, is what can be deduced from the order issued by the Administrative Court No. 3 of Almería.
The decision, dated April 1, 2019, determined according to the documentation seen by La Comarca, is that the plot is still owned by the Albox family who at court "PLEADS NOT EXECUTED" the Judgment number 81/2014, dated January 16, issued in these writs, "DECLARING THE NULLITY" of the Agreement adopted by the Town of Albox on February 10, 2017 as well as all dictations subsequent to this...
The Council assessed the land located in the center of the municipality as more than 4,000 meters and valued at 150,000 euros, a figure that according to the owner is well below the real value which could be over three million euros, that figure coming from an appraisal made by the family.
New damage to public coffers
The order issued by the court of administrative litigation No. 3 of Almería, although it is actionable in technical terms, annuls the procedures subsequent to the decision of the TSJA.
According to the legal background of these acts, qualified as illegal occupation of fraud by law, the family owner must also be compensated with 25% of the budget of material execution, in this case, according to consulted sources, the compensation apart from the real value of the land, could be around 100,000 euros, money that will come from the public coffers.
